Why TriMediation?
Mediation is a natural human interaction that has sustained societies since people first organized themselves into communal groups. More often than not in a dispute, a solution that reflects the best interests of both parties can be found by engaging the services of a neutral third party. Any decision you reach will be done mutually, thus making it more likely that its terms will be adhered to. Choosing mediation can mean avoiding unnecessary legal bills and protracted court trial times. Mediation can give parties better control of their own cases, since a decision reached by a judge after adversarial court proceedings will not only necessarily create a ‘winner’ and a ‘loser’, it will also be binding.
How Does Mediation Work?
Mediation is a service voluntarily chosen by both parties to help process the needs of each party and make them comprehensible to the other. The objective is to draft a solution together in which both parties walk away feeling that they have been heard and that their concerns have been addressed. A memorandum of understanding is reached, spelling out all the terms agreed upon. Once the parties’ respective lawyers provide a certificate confirming that legal advice was given, the mediator or the lawyers will draft a contract based upon the memorandum of understanding and the dispute will fall. It is this contract that then becomes binding, and a court in making decisions can use any breach of its terms.
Because a mediator’s purpose is to provide a neutral sounding ground, he or she cannot give legal advice. Many clients choose to have the mediator rather than their lawyers write the contract (after receiving legal advice) as it may save some expense.
A mediation can be open or closed. In an open mediation the mediator can disclose the result of the negotiations in a report, which can be used by the parties if they later go to court. If the mediation is closed, the mediator cannot be asked to disclose the details of the mediation. So, if the parties change their minds after getting legal advice, the court will not have access to what was agreed upon.

Kalim Khan BA, LLB, JD
After graduating from Trinity College, University of Toronto, Kalim proceeded to the joint Canadian and American LL.B./J.D. program at Windsor and Detroit, graduating in 1999. He was called to the bar under the auspices of the Law Society of Upper Canada in 2000. During his academic years he earned a Certificate in Mediation from the leading organisation in ADR, Stitt Feld Handy. Furthermore he completed an International Law Program at Kings College London (UK) where he was exposed to International Commercial Transactions, Maritime Law and Islamic Legal Theory.
After articling, he started his legal career as in-house Counsel for a software company in Toronto before joining the Government of Ontario as a mediator, where he negotiated various complex resolutions. He proved to be one of the most effective mediators there, securing the highest number of successful mediations during his tenure. Mr. Khan then joined Mr. Chehab, with whom he went on to form Chehab & Khan, the predecessor of Affinity Lawyers. The firm’s focus has primarily been on corporate/commercial matters and insurance litigation. Mr.Khan played a foundational role in the establishment of Islamic finance in Toronto, working over $100 million with various lenders. He also has legal experience with commercial transactions in China, the Middle East and the Caribbean.
Over the years he has proven to be an excellent advisor and negotiator for his clients as well as mentor for his colleagues. His personality and diverse International experience lends itself to becoming the strategic advantage you need on your management team.
Parveen Khan, LLB
Parveen Khan graduated from the International Baccalaureate Program from International School of Lusaka, Zambia. After extensively traveling throughout the world, she immigrated to Toronto, Canada.
Upon completing her LLB from University of London, she commenced working at Affinity Law as a Research Advisor. She has proven to be a tenacious legal researcher, always keeping pace with the fast-changing body of case law.
Parveen speaks four languages, and is working on becoming proficient at her fifth. She also holds a diploma in Arabic. She manages her law career along with running a home-based bakery. Being a home-schooling mother of four places her in a strategic position of exercising her creative dispute resolution skills on a daily basis, which she brings to bear on her clients’ mediations.
Joshua Meshack
Joshua is a 10 year veteran in the insurance claims industry. He is a graduate of the University of Buckingham Law School in the UK. Having worked on both the insurance and legal sides of the law he brings a unique perspective to insurance law. He has a passion for assisting people through the complex claims process and is dedicated to clients obtaining their legal rights. Over the years he has actively participated in numerous negotiations with insurance companies and legal professionals including discussions and preparation of case planning and strategy in writing and in person.
